Abstract

Franchising is a business cooperation between the two parties, namely the franchisor with the franchisees. Franchise agreements can be made in two forms, namely in the form of an authentic act made in notariil and in the form of the agreement under the hand. In this research are formulated the problem of why the unilateral termination of the agreement the franchise Sari Salon & Day Spa by franchisees, how legal considerations the judge's verdict in cassation MA RI number 995K/Pdt/2015, and what are the consequences of the law ruling Cassation MA RI number 995K/Pdt/2015. Research conducted legal research this is a normative, i.e. a process to find the rule of law, the principles of law, as well as legal doctrines in order to answer the legal issues at hand. The approach used in this study is the approach legislation and the approach to the case. Research results and discussion i.e. unilateral termination reason franchise agreement Sari Salon & Day Spa by a franchisee because the franchisee does not have a clear picture about the Sari Salon & Day Spa, including prospective financials; the operation of the franchise business Sari Salon & Day Spa does notcomply with the agreement. Legal consideration of the judge's verdict in Cassation MA RI Number 995K/Pdt/2015 is the franchisor can prove propositions lawsuit that franchisees have done deeds tort franchise cooperation agreements over the Sari Salon & Day Spa. Due to the legal Verdict of Cassation MA RI Number 995 K/Pdt/2015 is the termination of the franchise agreement by the franchisees franchise agreement lead to the Sari Salon & Day Spa ends; penalize a franchisee to pay fines/penalty to the franchisor. In order to provide legal protection for franchishor and franchisees, shaper legislation soon enact laws regulating the special agreement franchise in Indonesia as signs for the implementation of the covenant in franchise details and firmly set the rights and obligations of the parties to the franchise agreement franchise agreements that have to be made by deed notariil so as to provide balance to the parties.
