Abstract

This study discusses the policy formulation of two threatof two types of criminal sanctions against children who abuse narcotics. in the decision Number 44/Pid.Sus-Anak/2019/PN.Plg, the judge ruled on a child by threatening with two types of basic criminal sanctions against children as narcotics abuser, namely imposing a sentence on the child with the formulation of criminal imprisonment for 2 (two) years in LPKA and job training for 2 (two) months. The thesis discusses the problems: 1) is the policy of formulation of treatning with two types o criminal sanctions against child preparators of narcotics abuse contrary to the rigts of the child?; 2) How should the threat of two types of criminal sanctions against children who abuse narcotics be implemented?; 3) what is the ideal formulation of threatning with two types of criminal sanctions against child with preparators of narcotics abuse? the research method used in this study is normative research method with a statutory approach, a conceptual approach, an analytical approach, and a case approach. to carry out protect of children's rights it is necessary to reformulate the Act of the Republic Indonesia Number 35 of 2009 concerning Nrcotics and The Act Number 11 of 2012 concerning the Juvenile Criminal Justice System in wich both acts are contary to the protection of the rights of children, so thar in the future the children who are the preparators of narcotics abuse still get the best interests of the child keywords: formulation, cummulation, narcotics abuse
