Abstract

This research aims to analyze the implementation of the principle of Most Favoured Nation (“MFN”) in the case of a nickel ore trade dispute between Indonesia and the European Union. The Indonesian government issued a policy of banning the export of nickel ore with a grade of less than 1.7% for companies holding Production Operation Mining Permits (IUP). The implementation of the policy of banning nickel ore exports has caused problems and criticism by several countries due to the policy is considered as a violation against several provisions in The General Agreement on Tariffs and Trade (“GATT”). The research was conducted using normative juridical with a descriptive-analytical research specification, systematic narrative text, and a qualitative normative method. The result of this research is that the policy regarding the prohibition of nickel ore exports by the Indonesian government is still under the scope of the MFN exceptions, which are regulated under Article XX Letter (g) of the GATT 1994 and Article XI Paragraph (2) of the GATT 1994. The conclusion that can be drawn from this research is the Indonesian government allowed to issue an export restriction policy if it is in line with the conditions stated in General Exceptions GATT 1994.
