Abstract

Indonesia is known as a rich country with high horticultural potential, especially in the development of exports of tropical fruits to several neighboring countries. Technical regulations related to SPS Measures set by China since 2013 have a significant impact on the increase and decrease in the number of exports of tropical fruits from Indonesia, especially in 2018-2020. If it keeps happening, this can be a domino effect on other horticultural products and is unpredictable every year. Therefore, this study wants to analyze Indonesia's strategy in dealing with technical regulations related to SPS Measures set by China on tropical fruits from Indonesia so that the number of exports each year will increase. This research uses the theory of Issue Linkage (Substansive Linkage) which is based on negotiations with the concept of SPS Agreement in the WTO which uses three Annex (Lampiran) which are the basis for implementing the rules of each member country, including Definitions, Transparency of Sanitary and Phytosanitary Regulations, and Control, Inspection and Approval Procedures. The results of this study, Indonesia emphasizes the negotiation process through Indonesia-China and ASEAN-China meetings, arranges positions and collects relevant ministries to analyze together according to the basic rules that have been mutually agreed upon and WTO regulations if there are notifications related to SPS, to carry out supervision to to analyze together according to the basic rules that have been mutually agreed upon and WTO regulations if there are notifications related to SPS, to carry out supervision to evaluation, and conduct supervision to evaluation through Barantan (Badan Karantina Pertanian) so that local Indonesian products meet the applicable requirements. This result is expected to be an evaluation material for the Indonesian government, especially the Ministry of Agriculture and the Ministry of Trade, to continue to increase bargaining power in negotiating, monitoring, and implementing SPS Measures in accordance with WTO-oriented provisions.
