Abstract

Korupsi merupakan tindak pidana khusus yang saat ini menyorot perhatian dari masyarakat luas yang memberikan dampak buruk bagi perekonomian di suatu negara, dengan adanya Justice Collaborator diharapkan dapat memberantas kasus korupsi di indonesia. Adapun rumusan masalah dalam penelitian ini, yaitu Dasar pertimbangan Hukum Hakim dalam Putusan No. 48/Pid.Sus-TPK/2020/PN Jkt dan Putusan No.68/Pid.Sus-TPK/2019/PN Jkt.Pst. Perihal penetapan terdakwa sebagai Justice Collaborator tindak pidana korupsi serta perlindungan Hukum yang dimaksudkan ke pelaku Justice Collaborator sebagai saksi dalam Putusan No. 48/Pid.sus-TPK/2020/PN Jkt dan Putusan No.68/Pid.Sus-TPK/2019/PN Jkt.Pst. Metode penelitian yang digunakan yakni ialah yuridis normatif. Kesimpulan dari penelitian ini yaitu, Dasar pertimbangan Hukum Hakim Perihal penetapan terdakwa sebagai Justice Collaborator tindak pidana korupsi telah memperhatikan dari 2 aspek yakni yuridis dan non yuridis, sebagaimana telah dijelaskan Hakim dalam mempertimbangkan pelaku sebagai Justice Collaborator mengacu pada SEMA No 4 tahun 2011 Pasal 9 bahwa Putusan ini telah memenuhi syarat dan secara sah. Perlindungan Hukum yang didapat oleh Pelaku Justice Collaborator berupa Perlindungan fisik maupun psikis serta yang telah diatur oleh undang-undang LPSK.
