Abstract

Skripsi ini ditulis dengan judul “Pertimbangan Hakim Dalam Menjatuhkan Pidana Tambahan Berupa Uang Pengganti Kerugian Keuangan Negara (Studi Kasus Putusan Nomor; 49/Pid.Sus-TPK/2021/PN.Plg dan Putusan Nomor : 50/Pid.Sus-TPK/2021/PN.Plg). Rumusan Masalah yang penulis angkat dalam penulisan skripsi ini yakni : 1. Bagaimana pertimbangan hakim dalam menjatuhkan putusan terhadap tindak pidana korupsi berdasarkan pasal 2 Undang-Undang Nomor 20 Tahun 2001 Tentang Perubahan Undang - Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi (Studi Putusan Nomor : 49/Pid.Sus- TPK/2021/PN.Plg dan Nomor : 50/Pid.Sus- TPK/2021/PN.Plg)?, 2. Bagaimana pertanggungjawaban pelaku tindak pidana korupsi (Studi Putusan Nomor : 49/Pid.Sus- TPK/2021/PN.Plg dan Nomor : 50/Pid.Sus- TPK/2021/PN.Plg)?. Metode penelitian dalam skripsi ini dilakukan dengan menggunakan metode pendeketan normatif. Berdasarkan hasil penelitian pada Putusan Nomor : 49/Pid.Sus- TPK/2021/PN.Plg dan Nomor : 50/Pid.Sus- TPK/2021/PN.Plg terdakwa terbukti melakukan tindak pidana korupsi sebagaimana diatur dalam Pasal 2 Undang-Undang Nomor 20 Tahun 2001 Tentang Perubahan Undang - Undang Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi dengan mempertimbangan aspek yuridis dan non yuridis serta dapat dipertanggungjawabkan pidana atas perbuatan yang telah dilakukann terdakwa karena telah melakukan suatu tindak pidana dan telah memenuhi unsur-unsur pertanggungjawaban pidana yang telah diatur dalam Peraturan Perundang-Undangan.
