Abstract

Legal aid is provided by the country through the government for he welfare of the people However , not many people know that there is free legal aid for the community Legal aid hot only for criminal cases but also for civil cases . The role of the government , both the central government and the regional government in providing legal assistance , should have been in accordance with the current law . However , it is not the fact in the field . In general , we know that in handling civil cases , the party who has a client burdens his client with the but not all clients have the economic capacity to pay the cost of the case , such as cases of the Industrial Relations Court ( PHI ) and Divorce which can only go to the first instance . This study is an empirical study . The results of this study reveals that many people are still afraid to use legal aid services and do not know that there is free legal aid at the Legal Aid Institute ( LBH ) Palembang even though the requirements needed are much easier than those of the earlier time . Meanwhile , the dominant constraint factors are ( 1 ) insufficient budget / funds given by the government to the Palembang Legal Aid Institute , ( 2 ) legal aid applicants who are not honest in telling their financial capabilities and the chronology of case events that hinder the legal aid process . Lastly , although Article 19 of Law Number 16 of 2011 concerning Legal Aid does not oblige local governments , the local governments can set their own budget through the Regional Revenue and Expenditure Budget , as what Palernbang city government does on the principle of justice .
