Abstract

So far, there are no distinct legal framework regarding the investigation of sexual abuse and exploitation by United Nations peacekeeping forces in Democratic Republic of the Congo. Many perpetrators have not been held accountable and compensation for the victims is still unclear. This research will discuss the form of compensation and recovery for the victims of sexual abuse and exploitation by United Nations’ peacekeeping forces in Democratic Republic of the Congo and the obstacles and solutions regarding the implementation of legal protection towards the victims. This research is normative juridical with a descriptive-qualitative analysis method with sources taken from various legal materials as a literature review. The result of this research shows the troops contributing country is the one who have the responsibility and exclusive rights to sentence the perpetrators of sexual abuse and exploitation. Holistic approach towards the survivors has been taken to recover and reclaim the victim’s lives. Nevertheless, there are still some obstacles such as many areas in Democratic Republic of Congo which still have not gained the access to healthcare, the lack of accountability by the perpetrators, as well as the weak enforcement of justice by the sending state. The establishment of transitional justice mechanism are implemented effectively in handling the impunity and ensuring the victims to have access to justice and to get a fair compensation.
