Abstract

Kehadiran para pihak pada pembuatan akta Notaris merupakan hal yang harus dipenuhi, sesuai dengan Pasal 16 Ayat (1) huruf m Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN). Tetapi kegiatan pembuatan akta Notaris ini menjadi terhambat bahkan tidak bisa dilakukan karena penyebaran Corona Virus Disease 2019 (COVID-19) dan dikeluarkannya Keputusan Presiden Nomor 11 Tahun 2020 tentang Penetapan Kedaruratan Kesehatan Masyarakat Covid-19 oleh pemerintah serta Surat Himbauan Nomor 65/33-III/PP-INI/2020 oleh Pengurus Pusat Ikatan Notaris Indonesia (PP-INI). Rumusan masalah pada skripsi ini yaitu, bagaimana pengaturan pembuatan akta Notaris yang harus dihadiri para pihak pada masa Pandemi Covid-19. Dalam skripsi ini penulis menggunakan metode penelitian yuridis normatif. Setelah melakukan penelitian dapat disimpulkan bahwa, pada masa Pandemi Covid-19 kegiatan yang dilakukan Notaris harus tetap berjalan dengan membagi kegiatan menjadi kegiatan yang dapat ditunda dan tidak dapat ditunda serta tetap mematuhi protokol kesehatan. Keabsahan dari pembuatan akta Notaris tanpa kehadiran para pihak pada masa Pandemi Covid-19 dan sebelum pandemi Covid-19 adalah tidak sah.
