Abstract

The unavailability of regulations regarding the financial planning profession (financial planner), which in practice has entered the capital market sector in Indonesia, has created legal uncertainty. The objective of this study is to answer problems regarding the legal arrangements for the financial planning profession that arise in capital market practices, the legal relationship between the financial planning profession and the users of financial planning services, and the legal arrangements for the financial planning profession which should be in capital market law in Indonesia. This study is a normative legal study using statutory approaches, analytical approaches, conceptual approaches, analogical approaches, and futuristic approaches. The results of this study conclude that there has not been legal regulation for the financial planning profession, however there is a Code of Ethics and Practice Standards issued by the Financial Planning Standards Board (FPSB) as a professional certification body for financial planning which is licensed by the National Professional Certification Agency (BNSP), as well as in the Regulations Government Number 43 of 2015 concerning Reporting Parties in the Prevention and Eradication of Money Laundering Crimes. The legal relationship between the financial planning profession and the users of financial planning services is a contractual relationship that gives rise to rights and obligations stemming from anonymous agreements and based on the principle of freedom of contract. The regulation of the financial planning profession that should be regulated in capital market law in Indonesia is in the form of a Financial Services Authority Regulation (POJK) stipulated by the Financial Services Authority (OJK). OJK needs to immediately stipulate POJK related to the financial planning profession to solve the unavailability of regulations regarding the financial planning profession in the capital market sector and can carry out co-regulation in coordination with FPSB Indonesia.
