Abstract

The rehabilitation of the narcotics abusers at the National Narcotics Board (BNN) in South Sumatra Province is generally carried out directly. During the era of the Covid-19 pandemic, people had to keep their distance by avoiding crowds. This was done to protect the community according to the principle of Salus Populi Suprema Lex Esto. The problems analyzed in this study are how to apply the principle of Salus Populi Suprema Lex Esto in the practice of rehabilitating the narcotics abusers during the Covid-19 pandemic at the National Narcotics Agency of South Sumatra Province, the obstacles in applying the principle of Salus Populi Suprema Lex Esto, and the solutions to overcome these obstacles. This is a normative study using primary, secondary, and tertiary legal materials. This legal study uses a conceptual approach, a public service approach, and a statutory approach, and an inductive conclusion technique. The results of this study showed that the application of the Salus Populi Suprema Lex Esto principle in the practice of rehabilitating the narcotics abusers during the Covid-19 pandemic at the National Narcotics Agency of South Sumatra Province had not been fully implemented because the obstacles were found in the application of the Salus Populi Suprema Lex Esto principle in the practice of rehabilitating narcotics abusers during the Covid-19 pandemic at BNN in South Sumatra Province. The obstacles were the absence of implementing regulations, the lack of facilities and infrastructure and the lack of public awareness. In the future, it is hoped that the government will issue a public policy regarding the implementation of the codified Salus Populi Suprema Lex Esto principle and the BNN of the South Sumatra Province is expected to conduct outreach program to the community accompanied by improvement of facilities and Infrastucture.
