Abstract

The written agreement aims to ensure legal certainty and protection. One form of written agreement is the Credit Agreement. Generally using standard or standard forms, in the form of Notarial Deed or Deed Below. This study aims to find out why the credit agreement in general and especially the mortgage loan agreement is done in the form of Legalization compared in the form of Notarial Deed and why the House Ownership Credit Agreement is still required Legalization. This research uses empirical research method that is research by combining legal materials with existing data field, with empirical juridical approach that is approach used to see social phenomena related to law in practice, using primary law material, secondary and tertiary. Data collection techniques are done by collecting library data and interviews, analyzed through qualitative methods and with deductive deductions. From the results of the study of Housing Loan Agreement is generally in the form of deed under the hands of the Legalized compared with Notarial Deed because that determines it is the Bank / Creditors while the Debtor is not entitled to determine the form of credit agreement because the credit agreement is Take it or leave it. Bank in determining credit agreement in the form of Notarial Deed or Legalization based on Credit Policy determined based on loan size and to save the cost incurred by debtor, while the reason of House Ownership Credit Agreement is still required Legalization Notary for verification and burden of proof, if credit agreement only in the form of Deed Under the Hands alone without the Legalization then the burden of proof is on the creditor while the Credit Agreement Under the Hand in Legalization by Notary will be Deed of Hands with the Power of Proof same with Authentic Deed.
