Abstract

Skripsi ini ditulis dengan judul “Pertanggungjawaban Pidana Terhadap Pelaku Tindak Pidana Penghinaan Bendera Negara Republik Indonesia (Putusan Nomor: 73/Pid.B/2013/PN.KDS dan Putusan Nomor: 3/Pid.Sus/2022/PN.Bik). Adapun Permasalahan yang diangkat dalam skripsi ini adalah mengenai pertimbangan hakim dan pertanggungjawaban pidana terhadap pelaku tindak pidana penghinaan bendera Negara Republik Indonesia dalam Putusan Nomor: 73/Pid.B/2013/PN.KDS dan Putusan Nomor: 3/Pid.Sus/2022/PN.Bik. Skripsi ini menggunakan jenis penelitian yuridis normatif, pada Putusan Nomor: 73/Pid.B/2013/PN.KDS Terdakwa terbukti melanggar Pasal 67 huruf d Jo Pasal 24 huruf e UU RI No. 24 Tahun 2009 sedangkan pada Putusan Nomor: 3/Pid.Sus/2022/PN.Bik Terdakwa terbukti melanggar Pasal 66 UU RI No. 24 Tahun 2009. Penulis menarik kesimpulan bahwa sebelum menjatuhkan hukuman terhadap Terdakwa, hakim sangat memperhatikan aspek yuridis dan non yuridis sesuai teori penjatuhan sanksi. Pertanggungjawaban pidana terhadap pelaku tindak pidana penghinaan bendera Negara Republik Indonesia pada putusan diatas telah sesuai dengan teori pemidanaan yaitu Teori gabungan yang menyeimbangkan antara unsur pembalasan dengan norma tata tertib dalam masyarakat.
