Abstract

Regulation Number 30 of 2014 concerning Government Administration has widened the paradigm of the state administrative decision definition. Article 87 of the Government Administration Regulation states that factual actions are also interpreted as state administrative decisions. In line with this, the Government Administration Law transformation can affect to the decision of which court has the authority to adjudicate disputes over government officials' factual actions. The problems discussed in this study are 1. What are the implications of setting factual actions of government officials as state administrative decisions on the authority of the State Administrative Court, 2. What are the implications of setting factual actions as state administrative decisions on government officials? This research is normative legal research using statutory and conceptual approaches. The results indicate that regulating government officials' factual actions as state administrative decisions to the State Administrative Court extends the absolute competency authority of the State Administrative Court to adjudicate disputes over government officials' factual actions. The implications of setting factual actions as state administration decisions on government officials affect the administration of government to pay more attention to the general principles of good governance and applicable laws and regulations, bearing in mind that the government in making a decision/action does not harm any parties.
