Abstract

Writing thesis with the title "Rechterlijke Pardon's Juridical Review in the RKUHP as an alternative decision in the Reform of Criminal Law in Indonesia". The formulation of the problem in this study is: How is the application of sentencing theory in the concept of rechterlijke pardon as a Reform of Criminal Law in Indonesia?, and How is the Alignment of Goals in Law Enforcement when rechterlijke pardon as an alternative to a judge's decision?. The author conducted this research using the normative juridical research method with a statutory approach, a conceptual approach that is based on values, ius constitutum - ius constituendum and other legal materials. This study examines the idea of rechterlijke pardon as an alternative to judge's decisions that are oriented toward sentencing goals and sentencing guidelines through the provisions of the 2019 Criminal Code Bill, Law Number 48 of 2009, and other formal provisions. Rechterlijke pardon or the reason for the Judge's Apology contained in the RKUHP article 54 paragraph (2) of 2019 is a new idea in the Reform of Criminal Law in Indonesia.
