Abstract

This thesis examines the criminal responsibility of the Village Head as Perpetrators of Corruption Crimes in Decision Number 20/Pid.Sus-TPK/2020/PN.Plg and Decision Number 12/Pid.Sus-TPK/2019/PN.Plg. As for internal problems This research is the criminal responsibility of the village head as the perpetrator of the act criminal justice and the judge's legal considerations in making a decision against the head villages as perpetrators of corruption. The research method used is normative juridical research using statutory approaches and case approach. The results of the research show that Accountability criminal acts of corruption committed by the Village Head based on Decision Number 20/Pid.Sus-TPK/2020/PN.Plg and Decision Number 12/Pid.Sus.TPK/2019/ PN.Plg each Defendant was proven valid and violated the provisions of Article 2 UUPTK. Criminal Liability in these Provisions is in the form of crime imprisonment, fines and compensation. On both Verdict, ability the responsibility of the defendant did not fulfill the elements of forgiveness and justification so that may serve a prison sentence as determined by the judge. Judge's legal considerations in decision Number 20/Pid.Sus TPK/2020/PN.Plg and Decision Number 12/Pid.Sus.TPK /2019/ PN.Plg according to the ratio decidendi the Judge has considering based on existing rules by fulfilling the elements of the provisions Article 2 Paragraph 1 of the Corruption Law and the Panel of Judges are guided by a Circular Letter Supreme Court Number 3 of 2018 in determining Articles 2 and 3 based on the amount of state financial losses. The aggravating and mitigating reasons became a factor in the Panel of Judges passing judgment on the two Defendants both in the form of imprisonment, fines and compensation.
