Abstract

Indonesian migrant workers in the maritime sector have a high risk of becoming victims of rights violations. This happens because most of the activities take place in the middle of the ocean making it difficult to supervise, many recruitment processes are not in accordance with procedures, and national regulations which do not yet support the ratification of international conventions. Ratifying of the Maritime Labour Convention 2006 is one of the efforts made by the Indonesian government to improve the protection of Indonesian migrant works in the maritime sector. This research aims to see how Indonesia’s compliance with Maritime Labour Convention 2006 (MLC) to protect migrant workers in the maritime sector in 2016-2021. By using the compliance theory of Ronald B. Mitchell with data collection techniques through library research. The author sees that Indonesia’s level of compliance with the Maritime Labour Convention 2006 (MLC) is in Non-compliance Due to Incapacity. Non-compliance Due to Incapacity is non-compliance caused by the incompetence of both state and sub-state actors. The limitations mentioned could be related to financial, administrative, and technological issues. From these results the author conclude that Indonesia has carried out its commitment to MLC 2006, but there are inadequacies and limitations that result in violations of the rights of Indonesia migran workers on foreign ships.
