Abstract

Based on Supreme Court Decision Number 28 P/Hum 2021, in granting remission for corruption convicts there is no need to fulfill additional requirements as a justice collaborator. This is contrary to efforts to enforce the law on corruption through tightening remission requirements for corruption convicts. This research was a normative legal research, with the source of the research material from secondary data obtained through library research. The results of the study were, after the publication of the Supreme Court Decision Number 28 P/Hum 2021, the additional requirements as a justice collaborator were declared to have no binding legal force. As a results of the law, justice collaborators no longer had a legal umbrella and weaken the deterrent efforts for corruption convicts. The legal considerations from the Supreme Court Decision Number 28 P/Hum 2021 are : first, giving a deterrent effects must be in line with the principle of a sense of justice; secondly, remissions may not discriminate against the treatment of convicts; and third, excess capacity of correctional instituttions. His future criminal law policy was to reformulate the provisions of Articel 10 of the Minister of Law and Human Rights Number 7 of 2022 concerning the second Amandment to the Regulations of the Minister of Law and Human Rights Number 3 of 2018 concerning Terms and Procedures of Granting Remissions, Assimilation, Family Visiting Leave,Parole, Leave Before Release, and Conditional Leave (Permenkumham 7/2022), by adding a letter (letter a) which basically reads: "Convicts who commit acts of corruption to obtain Remission, apart from having to meet the requirements of good behavior and have served a criminal term of more than 6 (six) months, must also meet the requirements of being willing to cooperate with law enforcers to help uncover criminal cases he has committed.
