Abstract

In 2022, Taiwan banned the circulation of imported instant noodle products from a number of countries. It is known that as many as seven ships carrying imported instant noodle products with a total cargo of 4,431.96 kilograms, are prohibited from entering Taiwan by the local Customs Agency. This study aims to find out why Taiwan has implemented a policy of banning the circulation of imported instant noodle products in 2022. This research uses the concept of protectionism proposed by Phillip I. Levy (2009) through three forms of protectionism activities, namely: intentional protectionism, incidental protectionism and instrumental protectionism. The research method used is descriptive-qualitative. The data sources collected by the authors are primary data and secondary data. Data collection techniques are carried out by collecting document-based research archives, researching data found on the internet, and interviews. The results of this study show that the reasons why Taiwan implements a policy of banning the circulation of imported instant noodle products in 2022 are; First, intentional protectionism is carried out by diversifying the export market of processed food sellers by expanding domestic and foreign markets with new funds of NT$200 million. This was done by the Taiwan government as a response to the People's Republic of China which had imposed a number of sanctions and embargoes such as a ban on exports and imports for Taiwan. In addition, because instant noodles are Taiwan's flagship product which has a major impact on Taiwan's domestic economy, it is important for Taiwan to maintain its superiority competitiveness by subsidizing exports. Second, incidental protectionism is carried out by enforcing health and safety standards where Taiwan adopts recommendations and guidelines under the international legal framework, namely the ethylene oxide (EtO) limit contained in instant noodles is 0.01 ppm. In addition, it is also important for Taiwan to review the health losses caused by pesticide residues contained in instant noodle products circulating against Taiwanese consumers, and by ensuring that the products entering and circulating in Taiwan's domestic market are the highest quality products can certainly attract many investors. Third, instrumental protectionism is carried out by means of sanctions where if it exceeds the tolerance limit for the EtO contained, the batch of instant noodles must be returned or destroyed, and the inspection rate of the exporter will be increased. Thus making countries sanctioned by Taiwan such as Indonesia, the Philippines, and Vietnam carry out initiations such as by conducting policy studies on EtO instant noodles and their derivatives, providing support to companies to improve measures to ensure food hygiene and safety and meet the technical requirements of foreign markets. That way, through Taiwan's way of giving bluffs and attitudes that show that it is very firm and obedient under the framework of international law, regarding the legitimacy possessed by Taiwan as capital to maintain its existence in international politics.
