Abstract

Skripsi ini berjudul RATIO DECIDENDI HAKIM DALAM MEMUTUS PERKARA PRAKTIK PENCUCIAN UANG DAN ILEGAL AKSES INFORMASI ELEKTRONIK (PUTUSAN NOMOR 56/Pid.sus/2021/PN Kag). Maraknya kejahatan ITE dan Tindak Pidana Pencucian Uang yang terjadi belakangan ini terkhusus Ilegal Akses dan Pencucian Uang pada Bank BRI Rumusan masalahnya berupa Ratio Decedendi Hakim Dalam Memutus Perkara Nomor 56/Pid.Sus/2021/PN Kag Perihal Ilegal Akses Elektronik Dan Praktik Pencucian Uang serta Modus Kejahatan Dalam Praktik Pencucian Uang Yang Melibatkan Skema Ilegal Akses Informasi Elektronik. Metode yang digunakan dalam penelitian ini jenis penelitian normatif didukung oleh data sekunder. Dalam penelitian ini hakim memutus perkara menggunakan teori kekebasan hakim dengan tujuan demi memberikan kepastian, kesebandingan, keadilan, serta manfaat bagi semua orang. Akan tetapi, hakim tidak memperhatikan hal yang memberatkan dan tidak menggunakan teori gabungan serta tidak memperhatikan aspek Concursus Idealis. Kata Kunci: ITE, TPPU, Ratio Decidendi Hakim
