Abstract

Skirpsi ini berjudul: Sanksi Tindakan Rehabilitasi Bagi Pecandu Narkotika (Studi Putusan Nomor 1160/Pid.Sus/2016/PN Plg Dan Putusan Nomor 1026/Pid.Sus/2021/PN Rap). Adapun rumusan masalah yang penulis angkat dalam penulisan ini yakni 1. Bagaimana aturan atau pedoman mengenai rehabilitasi berdasarkan SEMA Nomor 4 Tahun 2010? 2.Bagaimana pertimbangan hakim dalam menjatuhkan tindak rehabilitasi pada (Studi Putusan Nomor 1160/Pid.Sus/2016/PN Plg dan Putusan Nomor 1026/Pid.Sus/2021/PN Rap)? Metode penelitian yang digunakan penulis dalam penulisan skripsi ini adalah jenis penelitian hukum normatif. Berdasarkan hasil penelitian ini menunjukkan bahwa Majelis Hakim dalam menetapkan kedua putusan ini yang sama-sama terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Penyalah Guna Narkotika Golongan I Bagi Diri Sendiri”.
