Abstract

Berbagai peristiwa yang berkaitan dengan kesehatan yang telah terjadi di beberapa negara anggota World Health Organization (WHO) ditentukan sebagai Public Health Emergency Of International Concern (PHEIC) karena dapat mengancam kesehatan masyarakat internasional dan memerlukan respon yang terkoordinasi antara WHO dan negara-negara anggotanya. Permasalahan yang diangkat adalah bagaimana WHO menentukan suatu peristiwa sebagai PHEIC dan bagaimana kewajiban negara-negara anggota WHO dalam menghadapi peristiwa PHEIC. Penelitian ini bersifat normative dan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Jenis data yang digunakan dalam penelitian ini adalah data sekunder yang diperoleh melalui studi kepustakaan. Hasil dari penelitian ini yaitu WHO menentukan suatu peristiwa sebagai PHEIC berdasarkan informasi yang diperoleh dari negara-negara anggota WHO dan saran dari Komite Darurat. Dalam menghadapi peristiwa yang mungkin merupakan PHEIC, negara-negara anggota WHO wajib menginformasikan segala hal yang diperlukan mengenai peristiwa tersebut kepada WHO. Various health-related events that have occurred in several state parties of the World Health Organization (WHO) are determined as Public Health Emergencies of International Concern (PHEIC) because they can threaten the health of the international community and require a coordinated response between WHO and its state parties. The problem raised is how WHO determines an event as a PHEIC and how the obligations of WHO state parties in dealing with PHEIC events. This study is normative and uses a statutory approach and conceptual approach. The type of data used in this study is secondary data obtained through the study of literature. The findings of this research is WHO defines an event as a PHEIC based on information obtained from WHO state parties and advice from the Emergency Committee. In the face of an event that may constitute a PHEIC, WHO state parties are obliged to inform WHO of everything necessary regarding the event.
