Abstract

Mixed marriages between Indonesian citizens (WNI) and foreign citizens (WNA) apply to two different legal systems. Indonesia adheres to a single citizenship system. Ownership of a single citizen has many legal issues ranging from issues of violation of civil rights, political rights, economic rights, and social rights. The discourse on the implementation of limited dual citizenship for mixed marriages is one of the efforts to minimize these legal problems. The that must study is whether the discourse of limited citizenship for diverse marriages does not conflict with the values of Pancasila as the State Foundation. The study uses a normative method through library research based on primary data (legal materials) using a statutory and philosophical approach. The analysis was carried out qualitatively with the technique of concluding inductively. Pancasila, as the basis of the state, provides a benchmark in its values which seeks to provide complete protection for every citizen. Welfare guarantees and protection for citizens are the basis for the possible application of limited dual citizenship status for mixed marriages.
