Abstract

This study is entitled "The Reformulation of Criminal Provisions on the Collection of Money or Goods". The method used in this study was a normative approach method. The legal materials used in the study were obtained from the primary, the secondary and the tertiary data. The materials were analyzed using prescriptive analysis and legal material analysis techniques, namely content analysis, and the conclusions were drawn by using deductive method. Based on the results of the study, it can be concluded that the collection of public money or goods are regulated by the Act No. 9 of 1961 on the Collection of Money or Goods and several other implementing regulations. Based on the provisions of the Act No. 9 of 1961, the collection of money or goods is intended for the development purposes in social welfare, mental/religious/spiritual, physical, and cultural fields with the permission of the authorized officials. At present, the collection of public money or goods is mostly done without following the provisions of the laws and regulations. This is partly due to the fact that the regulations are no longer in accordance with the times, scattered and sectoral in nature, and the public lacks of knowledge regarding regulations on the collection and management of public money or goods. As a result, there are many practices of collecting public money or goods that are not in accordance with statutory provisions. Also, the implementation of the sanction on the irregularities in the collection of public money or goods does not use the Act No. 9 of 1961 due to the lack of the regulations regarding criminal sanctions in the Act. Therefore, the reformulation of criminal provisions regarding the collection of public money or goods by adding special articles in the future can provide protection and legal certainty in Indonesian society.
