Abstract

This Thesis that entitled, "Legal Protection For The Victim Of Online Social Gathering Fraud Crime" will research about: how the arrangements of a legal protection for the victim of Online Social Gathering Fraud Crime, andhow the implementation of a legal protection for the victim of this crime and thenhow the implementation of a legal protection for the victim should be, As for the case that the author's focus in this thesis is related to some verdicts about The Online Social Gathering Fraud Crime thatsome of themareVerdict Number.1302/Pid.B/2015/PN.Bd and Verdict Number 1513/PID.B/2012/PN.JKT.TIM.The research method in this thesis used a normative research that doing an analysis of the issue through to the principles and theories of law approaching and refers to the legal norms contained in legislation, which the data collection collected by library research. The legal materialsusedprimary, secondary and tertiary legal materials, that consider as, relevant to the issues that discussed in this thesis.The results of research related to the answer of the issues abovearefirst : finding out more aboutthe rule of law that become as fundamental of alegal protection for the victim of Online Social Gathering Fraud Crime, which concluded that the rule of law on the victim’s protection is already exists, but still inadequate.Second :the urgency of legal protection for the victims is not only demanding the compensation, but also the judicial processing should be noticed by law enforcers as an indication how far the victim's protection can be fulfilled.Third : about how the implementation of a legal protection for the victim should be, there are actually two models of legal protection arrangements for victimsthat first is The Procedural Model Rightsand then The Services model .NowdaysIndonesia has not implemented a service model yet in providing legal protection for the victims that actually should be implemented so that the victims’rights can be can be fulfilled perfectly.
