Abstract

Pasca putusan Mahkamah Konstitusi Nomor 2/SKLN-X/2012 membawa perubahan dinamika ketatanegaraan Indonesia, secara khusus terhadap pelaksanaan kewenangan DPR-Presiden dalam pengambilan kebijakaan divestasi. Kebijakan divestasi sendiri mengalami dinamika yang berbeda dalam berbagai fase pemerintahan, baik pada masa orde lama, masa orde baru, maupun pada masa orde reformasi. Putusan Mahkamah Konstitusi ini juga memberi implikasi secara yuridis dan secara operasional terhadap pelaksanaan kewenangan DPR-Presiden dalam pengambilan kebijakan divestasi di Indonesia.
