Abstract

The title of this thesis is "Discretion Authority of Government Officials and Spatial Juridical Consequences in Light Rail Transit (LRT) Development Project In Palembang City". Researching the LRT infrastructure development in south Sumatra province more than 23,5 km as a national strategic project whichh is greatly urgent due to a race against time to welcome the 2018 Asian Games. Based on the above background, the researchers formulate the issues to be explored further as follows: 1. How is the application of discretionary authority of government officials in the process of infrastructure development for the public interest in light rail transport (LRT) in Palembang? 2. What are the legal consequences for spatial planning in Palembang with the development of Light Rail Transit (LRT) using the highway median? 3. What should be the infrastructure development mechanism for Light Rail Transit (LRT) in South Sumatra Province? The author of this research uses a normative legal method that contains an empirical side. The empirical side is exploratory with a statute approach, conceptual approach, legal philosophical approach, legal historical approach, and empirical approach. The research material obtained from literature and field research materials. The processing of legal materials is carried out by structuring, describing, and systematizing these legal materials into three levels, they are technical level, teleological level, and external systematization level. This research uses a qualitative method analyst which is this analysis using grammatical interpretation, systematic interpretation, opposing interpretation, extensive interpretation or broad interpretation, historical interpretation, comparative interpretation of law, anticipatory interpretation, and teleological interpretation. The conclusion techniques are using deductive and inductive paradigm. Based on these result the following conclusion of these research are: 1. 1. Discretion for the construction of the light rail transit (LRT) project in South Sumatra Province, they are: a. the government assignment mechanism is not a tender mechanism; b. A funding of the development project was funded by PT. Waskita Karya Tbk (Persero) in advance, and then the government allocates a project financing budget. 2 The local government ordered to adjusting the spatial plan in order to accommodate the construction of Light Rail Transit (LRT); 3. The mechanism that should be carried out by the government to build up the light rail transit (LRT) of South Sumatra Province are: a. The infrastructure development is financed by a State Budget which is carried out by an auction; b. Infrastructure Development with the mechanism of Public Private Enterprise Cooperation. As for the following recommendations are : Discretion should be examined in advance so that the infrastructure development in public interest is truly effective, well planned and adapted to the spatial concept and environmental impact analysis of a region.
