Abstract

The diversion attempt at the level of investigation at the Palembang City Police(Polresta Palembang) with the principle of restorative justice is not optimal because the case of Child in Conflict with the Law (Child) between year 2016 and 2018, which succeeded in diversion only amounted to 2 cases while 8 other cases failed. Therefore, the formulation of the problem in this thesis is related to how the application of the principle of restorative justice through diversion against Child at the level of investigation in Polresta Palembang, the constraints in its application, as well as criminallaw policies in the future. The results of this study is, the application of the principle ofrestorative justice through diversion against Child at the level of investigation in PolrestaPalembang is normatively carried out under Law Number 11 of 2012 concerning theCriminal Justice System through the provisions of Article 5 to Article 33 which regulates the authority of the Child Investigator in the case of children in the investigation, arrestand detention stage. Regarding to the diversion of the Child’s case successfully, PolrestaPalembang issued a Decree on the Termination of Case Investigation. Against thediversion of the case of the Child failed, then the Case File was transferred to theProsecutor's Office. Constraints experienced are : the reluctance of the victim/family ofthe victim to forgive the Child for his crime beyond the delinquency of the child whichcauses physical and mental suffering to the victim; Child cases for the period of 2016 to2018 are dominated by criminal offenses that are punishable by imprisonment for thelongest time/more than seven years, namely criminal offenses, gross abuse, mollesting,rape, and theft by force; and litigation reluctance to attend the diversion process.Criminal law policy in the future is, there must be guidelines available for theimplementation of diversion at the level of Investigation so that the Police can firstcommit and be proactive in implementing diversion before the diversion process continues to the Prosecutor's Office, for the sake of time, cost, and energy efficiency.
