Abstract

Children are classified into legitimate children and extramarital children. Referring toConstitutional Court Decision No.46 / PUU-VIII / 2010 which states that children born from illegitimate marriage has civil relationship with his father and his father's family. The South Jakarta Religious Court in Decision Number: 670 / Pdt.G / VIII / 2013 / PA.JS stipulates that extramaritalchildren have limited civil relationship with their biological father. Based on the aforementioned facts, legal issues arisen including: How is legal consideration of judges in the South Jakarta Religious Court Decision Regarding the Recognition of Extramarital Children. What is the Position and Legal Effects for Extramarital Children after the South Jakarta Religious Court Decision. And what is Notary’s role in Making Inheritance Deed For ExtramaritalChildren. The study used prescriptive legal science, legislation approaches, conceptual approaches, and case approaches. The results of this study are: Judicial legal considerations in the South Jakarta Religious Court Decision Number: 670 / Pdt.G / VIII / 2013 / PA.JS concerning Recognition of ExtramaritalChildren. Based on the Constitutional Court Decision Number: 46 / PUU-VIII / 2010 and the South Jakarta Religious Court Decision Number: 670 / Pdt.G / VIII / 2013 / PA.JS essentially extramaritalchildren have civil relationship with their mother and her family and with the father of whom can be proven based on science and technology. Position and Legal Effects of Extramarital Children after the South Jakarta Religious Court Decision Number: 670 / Pdt.G / VIII / 2013 / PA.JS isthat the children only have limited civil relations with their biological father, they have the right to get life facilities from their father, and have the right to get their father's name in their civil registration. Role of Notary in the Making of Deed for Extramarital Children. Eligible to get a mandatory inheritance from their biological father, may not exceed 1/3 of the inheritance in making the deed.
