Abstract

Peristiwa hukum yang sering dilakukan oleh masyarakat salah satunya yaitu mengadakan perjanjian. Menurut ketentuan yang berlaku perjanjian jual beli tanah haruslah dilakukan di hadapan PPAT akan tetapi dalam kehidupan sehari-hari ternyata masih banyak terjadi peralihan hak atas tanah yang dilakukan tidak di hadapan PPAT, hal yang demikian tentulah akan sangat merugikan pihak pembeli, karena dia hanya menguasai hak atas tanah secara fisik saja. Berdasarkan uraian di atas maka penulis ingin membahas tentang apa akibat hukum perjanjian jual beli tanah yang dilakukan tidak di hadapan PPAT dan apa upaya yang dapat dilakukan oleh pembeli, agar jual beli tanah yang dilakukan tidak di hadapan PPAT dapat mempunyai kekuatan hukum yang pasti. Skripsi ini menggunakan pendekatan melalui penelitian normatif dengan adanya penambahan berbagai unsur empiris. Hasil penelitian skripsi ini menunjukkan bahwa jual beli yang dilakukan tidak di hadapan PPAT adalah sah menurut hukum sepanjang syarat materiil terpenuhi. Upaya yang dapat dilakukan pembeli, agar jual beli tanah yang dilakukan tidak di hadapan PPAT dapat mempunyai kekuatan hukum yang pasti dengan meminta Penetapan Pengadilan Negeri yang memberikan kepastian hukum kepada pemohon sebagai pemilik yang sah atas tanah tersebut. Kata Kunci : Akibat Hukum, Perjanjian Jual beli Tanah, Kepastian Hukum ABSTRACT Legal events are often done by the community one of them is having a treaty. According to the provisions of the land buy and sell agreement must be done in the presence of Land Deed Official, but in the daily life, there are still many shifts in land rights that do not in the presence of Land Deed Official, such thing will be very detrimental to the buyer, because he only mastered the right to land physically. Based on the explanation above then the author wants to discuss about what the legal consequences of land buy and sell agreements do not in the presence of Land Deed Official and what efforts can be made by the buyer, so that the sale and purchase of land not in the presence of the Land Deed Official can have a definite legal force. This thesis used the approach through normative research with the addition of various empirical elements. The results of this thesis show that the sale and purchase is not in the presence of Land Deed Official is valid according to the law as long as the material requirements are met. Efforts that buyers can make, so that the sale and purchase of land not in the presence of Land Deed Official can have a definite legal force by requesting a state court designation that provides legal certainty to the ap plicant as a legitimate owner of the land.
