Abstract

Legal protection for the fulfillment of workers' rights is an important issue that must be addressed by the government. No increase in welfare of the workers is an important illustration that workers' rights have not been fulfilled considerably. Companies as employers should pay more attention to the rights of workers based on a sense of fairness and benefits for the workers. Employee Social Security System (BPJS Ketenagakerjaan) emphasizes the companies to register its workers in the program provided by Employee Social Security System in order to provide a sense of security and comfort for workers to avoid unwanted conditions. The companies are also required to pay monthly contributions to the Employee Social Security System so that the registered workers can receive its benefits. Companies with arrears will be sanctioned through a mechanism provided by Employee Social Security System inspectors, there is no alternative other than paying off the arrears, imposing sanctions on the companies can be in a form of reprimand letters to the revocation of certain licenses, the arrears of the companies to the Employee Social Security System resulting in the inability of the workers to claim their rights when something unexpected happens, workers do not get protection and the benefits of Employee Social Security System and ultimately workers became the victims of the actions of companies that commit violations. The normative legal research method was used in this studies with in depth and explicit use of concrete legal analysis as a reference to investigate the problem of the study.
