Abstract

The main problems analyzed in this paper is about The President Rodrigo Duterte's war on drugs policy and its influence on the security stability of ASEAN countries reviewed from the perspective of international human rights law. This issue is elaborated in several problem formulations, such as (1) Why did President Rodrigo duterte create a war on drugs policy in the Philippines. (2) What about President Rodrigo Duterte's war on drugs policy in terms of international human rights law. (3) Whether President Duterte's war on drugs policy can affect the security stability of ASEAN countries. This study aims to determine the reason of creating a war on drugs policy, understanding the war on drugs policy reviewed from international human rights law and its influence on the security stability of ASEAN countries. This study was analyzed in a normative juridical method with a memorandum approach and several related conventions. Legal materials are derived from literature studies that are examined qualitatively. The results of this study is indicate that the implementation of the war on drugs policy was created by low economic factors and drug crimes. Then it was reduced to a war on drugs policy that was applied in the double barrel project. Viewed from the perspective of international human rights law violates article 3.5,11 of the Universal Declaration of Human Rights 1948; Article 6,7,9,15 of the International Convention on Civil and Political Rights 1986; Article 2 of the Convention on Anti-Torture 1986; and article 1,11.12 of the ASEAN Declaration of Human Rights 2012. Some ASEAN member countries are affected by the war on drugs policy in the Philippines. Significant increase in dangerous drugs of the type of methamphetamine in the middle of 2016 - 2017, so that some ASEAN member countries anticipate by increasing security in the border region.
