Abstract

This thesis entitled "The Validity of Electronic Signatures in Notarial Deed Reviewed from the Regulation Number 11 of 2008 concerning Information and Electronic and Transactions and the Regulation Number 2 of 2014 concerning the Amendment ofthe Regulation Number 30 of 2004 concerning the Notary Office" studied the problems of aspects of juridical electronic signature according to the Regulation Number 11 of 2008 concerning Information and Electronic Transactions in view of the Regulation Number 2 of 2014 on amendments to the Regulation Number 30 of 2004 concerning the Notary Office, the norms setting and practices related to electronic signatures in the Notarial Deeds in the future. The theoretical bases used in this study were justice, legal certainty, and validity. The type of the study was a normative legal study using a statutory approach by studying the literature or secondary materials. The study materials consisted of primary legal materials, secondary legal materials, and tertiary legal materials processed in a systematic analysis. The materials were analyzed using legal interpretation. Theresults of the study concluded that the Notary must read the deed in front of the parties. This makes the arrangement potentially possible for the difference between the reading and the time marker indicating the date and/or the intended event as well.However, along with the times and technological advances at this time it can be possible to carry out the signing of electronic documents on securities because it will provide convenience for parties dealing with a notary in the event of a situation that is not possible. Therefore, the RegulationNumber 11 of 2008 concerning the Information and Electronic Transactions and the Regulation Number 2 of 2014 concerning the Amendment of Regulation Number 30 of 2004 concerning the Office of Notary Public have to be revised for something to comeso that the parties can carry out the electronic signatures without having face to face with the Notary or authorized official.
