Abstract

Skripsi ini membahas mengenai penjatuhan sanksi tindakan terhadap anak sebagai pelaku penganiayaan yang mengakibatkan mati yang ditinjau dari KUHP, dan Undang Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, serta pengaruh pelaku penganiayaan yang mengakibatkan mati terhadap proses hukum yang berjalan. Teknik yang digunakan dalam penumpulan data yakni studi pustaka dan penelitian normatif terhadap buku-buku dan peraturan perundang-undangan. Berdasarkan hasil penelitian, diperoleh kesimpulan, yakni: Pertama, tindak pidana penganiayaan mengakibatkan mati yang dilakukan anak tetap mempertanggungjawabkan tindak pidana tersebut berdasarkan Undang Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Kedua, bahwa hakim memutus dengan pasal 351 ayat (3) KUHP yang seharusnya anak tersebut dihukum ½ dari ancaman pidana tersebut namun tentu saja masih banyak faktor yang dipertimbangkan hakim dalam menjatuhi hukuman berdasarkan Undang Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak.
