Abstract

Korupsi telah menjadi masalah serius bagi bangsa Indonesia karena telah merambah keseluruh lini kehidupan masyarakat yang dilakukan secara sistematis sehingga memunculkan stigma negatif bagi negara dan bangsa Indonesia di dalam pergaulan masyarakat internasional. Independensi KPK menjadi tolak ukur untuk pelaksanaan pemberantasan korupsi, namun pasca berlakunya Undang-Undang Nomor 19 Tahun 2019 tentang Perubahan Kedua Atas Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi menimbulkan polemik dan kritik pada masyarakat. Adapun perubahan yang dikritisi yaitu dengan dibentuknya Dewan Pengawas KPK yang bertugas untuk mengawasi pelaksanaan tugas dan wewenang KPK. Salah satu tugas Dewan Pengawas KPK adalah memberikan izin atau tidak memberikan izin penyadapan, penggeledahan, dan/atau penyitaan. Tujuan Penelitian ini untuk menjelaskan hubungan hukum antara Komisi Pemberantas Korupsi sebagai lembaga independen dengan Dewan Pengawas dalam pelaksanaan penyelidikan; untuk menjelaskan bagaimana implikasinya terhadap independensi KPK dalam pelaksanaan penyelidikan. Metode Penelitian yang digunakan merupakan hukum normatif. Dari hasil penulisan dapat diketahui bahwa : Hubungan antara Dewan Pengawas dan KPK sebagai lembaga independen dalam menjalankan pemberantasan tindak pidana korupsi merupakan hubungan yang timbul berdasarkan fungsional, karena dalam pelaksanaan pemberantasan tindak pidana korupsi, Dewan Pengawas berfungsi dapat memberikan Izin dan/atau tidak memberikan izin dalam hal penyidikan. Implikasinya perubahan kedua Undang-Undang KPK terhadap independensi KPK dengan keberadaan Dewan Pengawas membuat kinerja KPK dalam penyidikan/penyelidikan menjadi tereduksi sehingga mempengaruhi indepedensi KPK. Belum ditambah lagi KPK masuk dalam ranah eksekutif sehingga dikhawatirkan akan ada campur tangan /intervensi dari pemangku jabatan tertinggi eksekusif. Jadi, kata indepedensi pada KPK hanya penyebutan saja. Kata Kunci: Korupsi, Indepedensi, KPK ABSTRACT Corruption has become a serious problem for Indonesian people because it has infiltrated all aspects of life and is carried out in a systemaatic manner, creating a negative image for the Indonesian state and nation in the international community. Although the independence of the KPK (Corruption Eradicattion Commission) is a benchmark for eradicating corruption, it has sparked controversy and criticism in the community following the enactment of Law Number 19 of 2019 concerning the Second Amandement to Law Number 30 of 2002 concerning the Corruption Eradication Commission. The changes that drew criticism included the establishment of the KPK Supervisory Board, which was charged with supervising the KPK’s performance of its duties and authorities. One of the Supervisory Board’s responsibillities is to grant or deny permission for wiretapping, rummaging, and/or confiscation. The purpose of this study is to describe the legal relationship between the Corruption Eradication Commission as an independent institution and the Supervisory Board when conducting invetigations, The method of research is normative law. The findings indicate that the relationship between the Supervisory Board and the KPK as an independent institution charged with eradicating corruption is functional in nature, as the Supervisory Board has the authority to permit and/or deny investigation. The implication is that the second amandement to the KPK Law regarding the KPK’s independence, which included the establishment of the Supervisory Board, reduced the effectiveness of the KPK’s investigation, there by impairing the KPK’s independence. Additionally, because the KPK is part of the executive division, it is feared that the highest executive officer will intervene. As a result, the term “independence” at the KPK is merely a declaration.
