Abstract

Permasalahan yang dibahas dalam skripsi ini adalah apakah konsep restorative justice dapat diterapkan dalam Putusan Mahkamah Agung Nomor 281 K/Pid.Sus/2019 dalam perkara persetubuhan anak dan bagaimana pertimbangan Hakim pada tingkat kasasi pada putusan Nomor 281 K/Pid.Sus/2019 terhadap putusan tingkat pertama dan tingkat banding yang telah menjatuhkan vonis di bawah ancaman minimum dalam perkara persetubuhan anak. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (Statute Approach), pendekatan konseptual (Conseptual Approach) dan Pendekatan Studi Kasus (Case Study Approach). Hasil pembahasan dari penelitian skripsi ini adalah restorative justice sebagai tujuan pemidanaan telah diterapkan pada Putusan Nomor 281 K/Pid.Sus./2019. Pada Putusan Nomor 281 K/Pid.Sus/2019 terdapat pertimbangan-pertimbangan hakim menjatuhkan pidana di bawah ancaman minimum secara yuridis juga mempertimbangkan faktor-faktor non yuridis.
