Abstract

Penelitian ini dilatarbelakangi oleh maraknya kasus kebakaran hutan dan lahan di Indonesia, Provinsi Sumatera Selatan merupakan salah satu daerah yang mengalami kasus kebakaran hutan dan lahan yang besar. Jenis penelitian yang digunakan adalah penelitian empiris. Pendekatan penelitian yang digunakan adalah Perundang-undangan, Kasus, Konseptual dan Komparatif. Hasil penelitian menunjukkan bahwa:1. Implementasi kewajiban negara berupa Posiive Obligation telah berjalan dengan efektif sesuai dengan tujuan yang ingin dicapai dari isi ketentuan peraturan sebagai landasaan melalui Peraturan Daerah Provinsi Sumatera Selatan No 8 Tahun 2016 tentang Pengendalian Kebakaran Hutan dan/atau Lahan 2. Penanganan kasus kebakaran hutan dan lahan oleh Pemerintah Provinsi Sumatera Selatan mengalami beberapa kendala, yaitu mengenai anggaranm, koordinasi, dan juga lembaga. Kata kunci: Kewajiban Negara, Positive Obligations, Kebakaran Hutan dan Lahan.
