Abstract

Fingerprint actually has an important position in the process of writing an authenthic deed because it serves as external evidence for the deed and as proof of self identification of the appear that he was actually present and signed the minutes of the deed directly.This study aims at analyzing : (1) the regulation of the implementation of Fingerprint Attachment on the minutes of the deed, (2) the legal strength of authentic deed proof on the minutes of the Deed if there is no fingerprint attachment, and (3) future arrangements related to the implementation of the implementation of fingerprint attachment in the minutes of the Notary deed. It is a normative research using primary, secondary and tertiary legal materials. The results indicate that the regulation related to fingerprints is still not firm and has not been regulated fully. As a result, a policy is needed as a guide for notaries to achieve uniformity in fingerprint attachment in order to provide proper legal certainty in the process of deed writing. The legal strength of authentic deed proof on the minutes of deed without fingerprint attachment is weak or degraded into an underhand letter because the deed loses it’s authenticity due to non-fulfillment of the formal requirements. In the future, Regulation of the Minister of Law and Human Rights of The Republic Indonesia concerning the obligation to attach fingerprints to the minutes of deed before a Notary is needed to be established, considering that the minister has the authority on the implementation of the office and positions of a Notary.
