Abstract

A trademark is a business actor’s primary identity that serves as a symbol and distinguishing sign for the business that was run alongside existing competitors. The purpose of this study is to conduct an analysis of the first to file rule as defined by the Trademarks and Geographical Indications Law.Another objective is to achieve legal certainty regarding the first to file principle, its implementation, and the critical nature of regulating the requirement to transfer rights via notary deed.The problem of this research is related to the regulation of the first to file principle under the Trademarks and Geographical Indications Law, the legal basis for the judge’s efforts to settle registered trademarks in light of the Supreme Court's decision Number 575 K/Pdt.Sus-HKI/2020, and the role of the Notary in trademark license agreements. This is a normative study that utilized primary, secondary, and tertiary legal materials. The findings of this study indicate that Indonesia’s trademark registration system, which is based on the first to file principle, ensures proper protection and legal certainty for trademark holders, as the first registrant is entitled to exclusive rights and economic benefits from the mark. The trademark right may be transferred by agreement or through the use of a private letter or a notarial deed. Trademark registration under the first to file principle serves as the foundation for granting rights and determining the acquisition of rights to registered trademark holders for the purpose of utilizing and exercising their rights in commerce. The government should make the transfer of rights of the trademark mandatory based on a notarial deed because it is related to establishing and fulfilling the rights of the trademark license holder to freely use and exploit the trademark’s exclusive rights and economic value.
