Abstract

This study discusses the authority of the Consumer Dispute Settlement Agency (BPSK) to supervise the inclusion of standard clauses in business contracts but at a later time is declared null and void by general court. BPSK must be assertive in supervising the inclusion of standard clauses since their decision is final and binding, However, an objection is allowed to be submitted to court. The provisions the Consumers Protection Regulations (UUPK) clearly control the prohibition of the inclusion of standard clauses. The violators are subject to punishment in accordance with applicable laws. This study aims at analyzing (1) the authority of BPSK in supervising the inclusion of standard clauses that violate the UUPK, (2) legal certainty of BPSK decisions and (3) forms of legal protection for consumers in the event that BPSK decisions are declared null and void. It is a normative juridical with legislation, concept and case approaches. The results showed that BPSK was not authorized to take action against business violating of the UUPK regarding the inclusion of standard clauses, and to asked business actors to revoke the standard clauses. BPSK is passive and it only acts based on complaints from consumers. Its decision does not provide legal certainty for consumers since it is final and binding and can be filed for objection to the court. This is actually a contradiction. Consumer legal protection is only preventive in nature, while repressive legal protection is given so that business to delete standard clauses that violate of the UUPK, the inclusion of which would render the standard clauses null and void. It is suggested that BPSK be more active and assertive in imposing repressive actions against business violating the UUPK. Furthermore, it is necessary to have a clear revision of the regulations on consumer protection for a stronger legal umbrella of BPSK decisions. Keywords: Standard Clause, Consumer, Legal Protection
