Abstract

This thesis entitled: "The Role of Notaries As Capital Market Supporting Profession in Legal Protection Against Investors to Avoid Losses in the Practice of Capital Market Manipulation", examines the problem of the role of notaries in legal protection against investors to avoid losses due to market manipulation practices. In accordance with the problem and purpose of the study, the nature of this research is normative legal research that identifies legal processes. Conducted by examining positive law, the rule of law, and the rule of law. This study uses the Statute Approach approach by reviewing applicable laws and regulations related to problems and analytical approaches and the conceptual approach that is carried out by studying the laws and regulations. and doctrine. This research uses research sources called legal materials, both primary, secondary and tertiary legal materials, and uses information as a support obtained from informants. The analysis was carried out with the material of the research carried out by descriptive qualitative method which was carried out by systematically describing the library material and writing or the words of the interview results from informants to obtain the results of the analysis. Based on the results of the study, it can be concluded that the role of the notary as a capital market support profession is in the process of going public where the notary is authorized to make and check the validity of deeds or agreements relating to the GMS and changes in the articles of association. In an effort to protect the law against investors, the notary does not have an active role, but only passively where the notary checks the legitimacy of material facts and compiles documents relating to going public.
