Abstract

Skripsi ini berjudul “PERTANGGUNGJAWABAN PIDANA PELAKU TINDAK PIDANA PENGAKUTAN HASIL HUTAN DITINJAU DARI UNDANG-UNDANG NOMOR 18 TAHUN 2013 (STUDI PUTUSAN Nomor 05 Pid.Sus/2019/PN Mna)” adapun permasalahan dalam skripsi ini yang pertama adalah Bagaimana Pertanggungjawaban Pidana Pelaku Pengangkutan Hasil Hutan Tanpa Izin ditinjau dari Undang-undang Nomor 18 Tahun 2013. Untuk menjawab permasalahan tersebut penulis mendapati bahwa pertanggungjawaban pelaku tindak pidana pengangkutan hasil hutan menurut Undang-undang nomor 18 tahun 2013 yang ditinjau dari Studi Putusan Nomor 05 Pid.Sus/2019/PN Mana Provinsi Bengkulu bahwa putusan telah memenuhi ketentuan pidana sebagaimana yang diatur dalam Undang-undang Pencegahan dan Pemberantasan Perusakan Hutan. Namun, dalam pelaksanaan pengawasan hasil hutan masih terdapat banyak kekurangan, termasuk pula peran pemerintah ,aparat kepolisian, dan instansi terkait dengan harapan agar fungsi pengawasan dapat lebih aktif terhadap pengawasan pelaksanaan distribusi hasil hutan.
