Abstract

Narcotics are substances or drugs derived from plants or non-plants or non-plants, both synthetic and semi-synthetic, which can cause a decrease or change in consciousness, loss of taste, reduce to eliminate pain, and can cause dependence, which are divided into groups- groups that exist in Law Number 35 of 2009 concerning Narcotics. There are many perpetrators of narcotics crimes, from Indonesian citizens to foreign nationals who enter the territory of the Republic of Indonesia also become perpetrators of narcotics crimes. The formulation of the problem in this study is the basis for the judge's legal considerations in imposing a crime on Decision Number 135/Pid.Sus/2017/PN.Gin and Decision Number 1599 K/Pid.Sus/2012 concerning foreigners who commit narcotics crimes in Indonesia and accountability of the perpetrators of this narcotics crime. This research uses normative research with a case study approach. As for the conclusion in this study, the consideration of the Panel of Judges in Decision Number 135/Pid.Sus/2017/PN.Gin is that the defendant is proven to have abused narcotics in accordance with Article 112 paragraph (1) of the Narcotics Law and the Panel of Judges in Decision Number 1599 K/ Pid.Sus/2012 rejected the appeal from the defendant. Criminal liability for the perpetrators of this narcotics crime is sentenced to a minimum of four years and a maximum of twelve years imprisonment and a minimum fine of Rp. death penalty, life imprisonment, or a minimum imprisonment of six years and a maximum of twenty years and a maximum fine as referred to in paragraph (1) plus a third. The indictment of the public prosecutor for each defendant has fulfilled the elements and the judge has been right in giving a decision for the defendant.
