Abstract

The execution auction of the Mortgage Certificate (SHT) is carried out with the title of irah-irah executorial power of "For the sake of justice in the name of one and only God” (irah-irah) based on the Article 20 of the Act No. 4 of 1996 concerning Mortgage Rights (UUHT) through the State Property and Auction Service Office of Palembang (KPKNL). The problems that arise during the execution auction relate to underhand sales, auction limit prices, collateral objects that have not been emptied, and lawsuits/verzet. The discussion of this study relates to the implementation of the Article 20 of the UUHT in ensuring the interests of the parties in the KPKNL. The objective of the study is to analyze the legal force of SHT executions that have irah-irah in their implementation in order to ensure legal certainty at the KPKNL, to analyze and find legal consequences for the parties against the execution and sale of mortgage objects in it that are not in accordance with what is required by UUHT as well as to analyze and find the regulations that should be applied regarding the execution of the SHT by the KPKNL. The method of this study was normative research method which was supported by the empirical data. Based on the results of the study, the title of the executorial power of irah-irah already has strong legal certainty for execution. In some cases there are obstacles, including cancellation of auctions at the request of the seller, lawsuits from debtors and third parties. The legal consequences for the parties against the execution and sale of mortgage objects that are not in accordance with the UUHT are null and void because subjective conditions are not fulfilled by not making announcements in the mass media. The arrangement for the execution of the execution auction at the KPKNL is guided by UUHT Jo. Minister of Finance Regulation No.213/PMK.06/2020 concerning Auction Implementation Guidelines. In this arrangement there should be additional related norms, regarding the limit price of the auction object set by the Independent Appraisal Service Office and the obligation of the KPKNL as the seller of the mortgage object to vacate if an execution auction has been carried out in the Article 20 of UUHT.
