Abstract

This thesis is written against the backdrop of the fact that at this time there are still court decisions that do not prioritize the rights of children who are victims of pornography. The problems analyzed in this paper relate to the juridical aspect of legal protection for child victims of pornography through the Lumajang District Court Decision With Case Number 28/Pid.us/2019/PN Lmj and the Dumai District Court Decision With Case Number 433/Pid.Sus/2020/PN Dum and the ideal legal protection for child victims of pornography crime through the implementation of the Act Number 44 of 2008 concerning Pornography in the future. This is a normative legal study using a conceptual approach, a statutory approach, and a case approach. The results of this study conclude that the judge's decisions regarding the two pornography cases involving children as victims have not been able to prioritize children's rights.Supposedly, the judge not only imposed the threat of punishment as regulated in the Act Number 44 of 2008 Concerning Pornography but also sentenced the perpetrators of child pornography with the punishment as stated in the Act Number 35 of 2014 Concerning Child Protection. In addition, the ideal legal protection for children who are victims of pornography crimes through the implementation of the Act Number 44 of 2008 currently does not prioritize the rights of child victims of pornography. A child should be considered as someone who is not yet an adult as well as the next generation of the nation. in the future, with regard to children, who are victims of pornography crimes, judges should be able to consider and prioritize the rights of children who are victims of pornography.The judge's decisions shouid be able to include the fulfillment of children's rights that can be restored so that it can become jurisprudence for other judges in prioritizing the rights of children who are victims of pornography Keywords: Child Victim of Crime; Pornography Crime; Legal Protection
