Abstract

This research is motivated by differences of opinion from policy actors who are members of a tripartite institution called the Wage Council which consists of three elements, namely the government element, the entrepreneur element, and the worker/labor union element. The background of the difference between the three elements is PP 36 of 2021 concerning wages. Elements of the government and elements of entrepreneurs stated that they followed the applicable rules that had been set by the government, while the labor element had different opinions which stated that the process of determining the Palembang UMK in 2022 using PP 36 of 2021 was not in favor of the rights of the workers and also the copyright law. The work which is the parent of PP 36 of 2021 was also declared unconstitutional by the Constitutional Court. This research was conducted at the Manpower Office of Palembang City. This type of research is descriptive using qualitative methods. The types of data used are primary data and secondary data, while the data collection techniques are through observation, interviews, and documentation. This research uses David Easton's model of policy formulation theory. The results of this study indicate that the policy formulation in determining the minimum wage for the city of Palembang in 2022 is going well even though it is not fully accepted by all members of the city wage council. recommendation of the calculated wage value and sued the South Sumatra Governor's Decree on the 2022 Minimum Wage at the Palembang City Administrative High Court. Suggestions related to the findings of this study are that the city wage council should synergize and work together in compiling the calculation of the value of wages in order to realize the amount of UMK that is mutually agreed upon in order to provide justice to all policy actors involved.
