Abstract

This thesis is entitled Comparative Study of Sanctions for the Crime of Murder according to the Criminal Code (KUHP) with Islamic Criminal Law regarding Jarimah Qisash. The formulation of the problem raised is what are the forms and types of sanctions for murder according to the Criminal Code and Islamic Criminal Law, and how to apply the sanctions for murder according to Indonesian Positive Law with Islamic Criminal Law regarding Jarimah Qisash. Thesis writing uses the normative method which is done by reviewing, studying and then reviewing legal materials. The data analysis technique used qualitative methods, described legal materials in the form of descriptions and arranged systematically. The results of the study show that the criminal sanctions for murder in the Criminal Code are in the form of capital punishment, imprisonment, confinement and fines, while in Islamic criminal law in terms of punishment, namely Jarimah Hudud, Jarimah Qishas wa Diyat, Jarimah Kifarat and Jarimah Ta'zir. The similarity, the Criminal Code has the same death penalty which is equivalent to Jarimah Qisash. The difference is that the death penalty is given to perpetrators of premeditated murder, while Jarimah Qisash is threatened with intentional murder. Both have repressive and preventive measures, but their implementation needs to be regulated constitutionally and not deviate from the positive law of the country that implements these two legal systems.
