Abstract

In the Province of South Sumatra, especially Palembang, there are foreigners who violate the deadline for stay permit and misuse the activities designated in the stay permits which are therefore dealt with by the immigration office class I TPI Palembang through administrative action and imposition of criminal sanctions. this research reviewes: a. non-penal efford (prevention) to deal with immigration crimes by foreigners in the jurisdiction of the palembang immigration office b. factors affecting law enforcement against foreigners who commit criminal act in the jurisdiction of the Palembang Immigration Office c. law enforcement on immigration crimes by foreigners in the future. this research was an empirical normative legal research, with data obtained through literature studies and field studies. the result of the study showed law enforcement for foreigners who violate immigration measures. from the aspec of the scope of immigration violations, it was known that the obstacle came from the weak factor of a culture of legal awareness and from the factor of law enforcers who were wrong in applying the legal subject and the applicable articles. Law enforcement efforts in immigration crimes by foreigners in the future would be carried out through a penal policy, namely the addiction of a number in article 1 of the immigration law regarding the meaning of 'every person', which fully explains: 'every person means an individual as indonesian people'. to avoid misunderstandings about law enforcement. Based on non-penal, the focus was on: first, immigration supervision which included supervision, sedond, implementation of the immigration intelligence function, and third, socialization to the public, regarding the role of the community in supervising foreigners who were suspected of committing immigration crimes and reporting them to the authorities or office palembang immigration.
