Abstract

Skripsi ini berjudul “Pengembalian Kerugian Negara Sebagai Alasan Peringan Bagi Pelaku Tindak Pidana Korupsi (Studi Putusan Nomor: 04 /Pid.Sus-TPK/2021/PN.JMB dan Putusan Nomor : 5 /Pid.Sus-TPK /2020/PN.Dps)”. Adapun permasalahan dalam skripsi ini ialah Konsep Pengembalian Kerugian Negara Sebagai Alasan Peringan Pidana Dalam Hukum Positif di Indonesia serta Ratio Decidendi Hakim Dalam Mengimplementasikan Konsep Pengembalian Kerugian Negara Pada Putusan Nomor: 04 /Pid.Sus-TPK/2021/PN.JMB dan Putusan Nomor : 5 /Pid.Sus-TPK /2020/PN.Dps. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis-normatif. Pendekatan yang digunakan ialah pendekatan perundang-undangan (statue approach) dan Pendekatan Kasus (Case Approach). Adapun sumber data yang digunakan terdiri dari Bahan Hukum Primer, Bahan Hukum Sekunder dan Bahan Hukum Tersier. Pengumpulan bahan hukum diperoleh melalui riset kepustakaan (library research). Berdasarkan hasil penulisan yang dilakukan dapat diperoleh kesimpulan bahwa seorang pelaku tindak pidana korupsi bisa mendapat alasan peringan pidana dengan beberapa syarat, salah satunya ialah mengganti kerugian negara meskipun menurut Pasal 4 UU Pemberantasan Tindak Pidana Korupsi tidak dapat menghapus pidana. Selain itu, berdasarkan Ratio Decidendi Hakim, terdakwa terbukti secara sah dan meyakinkan melakukan Tindak Pidana Korupsi sebagaimana yang didakwakan oleh Jaksa Penuntut Umum.
