Abstract
Actions without rights to deliberately transfer land rights belonging of someone to other party is a crime of land rights, which if carried out jointly by involving many parties is an Organized Land Crime. One of the modes used to transfer land rights is to use a fake sale and purchase deed drawn up by the Land Deed Official. In this paper, we will discuss the legal consequences and responsibilities of the Land Deed Official for fake certificates used in organized land crimes, this research is carried out normatively. The results of this study confirm that the responsibility and legal consequences carried out by the Land Deed Official for the falsification of the deed which is the basis for the transfer of land rights can be subject to criminal penalties under article 263 jo. Article 264 of the Criminal Code regarding forgery of authentic letters and deeds, administrative sanctions, namely dishonorable dismissal, as well as efforts that can be made to take over the land rights by canceling the land certificate with a lawsuit to the state administrative court based on the Forgery of Deed Sale and Purchase which has been canceled with a lawsuit to the District Court of Justice. It is hoped that the government can increase efforts to protect the law against owners of land rights and other affected parties by considering establishing a special land court in order to create a settlement system that is fast, simple and cheap, thereby helping to prevent and minimize the occurrence of Organized Land Crimes. using a Fake Sale and Purchase Deed from PPAT.
